These Terms of Service ("Terms") apply to all purchases made through sunsterbeauty.com. Please read them carefully and retain a copy for your records.

1. Definitions

"The entrepreneur", "we", "us", "our" refers to Sunster, operated by ESCAPE VELOCITY GROUP LIMITED.

"You", "the customer" refers to the person purchasing products through sunsterbeauty.com.

"Products" refers to all skincare products offered on the website.

"Consumer" refers to any customer who is a natural person acting for purposes outside their trade, business, craft or profession.

2. General

These Terms apply to all orders placed through sunsterbeauty.com. By completing a purchase, you confirm that you have read and accepted these Terms.

We sell to consumers only. Products are intended for personal use.

3. Website Use and Eligibility

By using the website and agreeing to these Terms, you confirm that you are at least the age of majority in your place of residence, or that you are using the website with the involvement of a parent or guardian, and that you have the legal capacity to enter into a binding contract with us.

4. Acceptable Use

You agree not to use the website for any unlawful purpose or in any way that could damage, disable or impair it. In particular, you agree not to: attempt to gain unauthorised access to the website or its systems; introduce viruses or malicious code; collect or track the personal information of others; infringe our intellectual property rights or those of any third party; or post abusive, obscene, defamatory or misleading content.

We may suspend or terminate your access to the website if you breach these Terms.

5. Prices and VAT

All prices are listed excluding customs clearance costs and import VAT. These additional costs will be for the account and risk of the customer. The postal and/or courier service will make use of the special arrangement for postal and courier services with respect to the import. This arrangement applies when the goods are imported into the EU country of destination. The postal and/or courier service collects the VAT (whether or not together with the customs clearance costs charged) from the recipient of the goods.

The place of supply, pursuant to Article 5, paragraph 1, of the Turnover Tax Act 1968 (Wet op de omzetbelasting 1968), is located in the country where the transport begins. In the present case, this supply takes place outside the EU. Following from this, import VAT and/or customs clearance costs will be collected from the customer by the postal or courier service. Consequently, no VAT will be charged by the entrepreneur.

We try to display prices and product information accurately, but errors may occasionally occur. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders where information was inaccurate, including after an order has been submitted. Prices are subject to change at any time without notice.

6. Import Responsibility

By placing an order, you acknowledge and accept that you are acting as the importer of the products into your country. You are solely responsible for ensuring that the products comply with all applicable laws and regulations in your country, and for paying any applicable import duties, taxes, or customs fees.

7. Product Information and No Medical Advice

Information on the website is provided for general informational purposes only and is not medical advice or a substitute for advice from a qualified healthcare professional. Our products are cosmetic skincare products. If you have a skin condition, allergy or other health concern, consult a healthcare professional before use.

We make no guarantee that you will achieve any particular result. Results may vary depending on individual factors. We have made every effort to display product colours and images accurately, but cannot guarantee that your screen will display colours accurately.

8. Payment

We accept Visa, Mastercard, Apple Pay, Google Pay, PayPal, and Shop Pay. Payment is processed at the time of purchase.

By submitting payment information, you confirm that you are authorised to use the payment method and that the information provided is complete and accurate.

9. Order Acceptance

Your order confirmation acknowledges receipt of your order but does not constitute our acceptance of it. A contract is formed only when we dispatch the products. We reserve the right to refuse or cancel any order for any lawful reason, including suspected fraud, pricing errors or stock unavailability. If we cancel an order you have already paid for, we will refund you in full.

If you need to change or cancel a pending order, contact support@sunsterbeauty.com as soon as possible. We will try to accommodate the request but cannot guarantee it if the order has already been processed.

10. Delivery

Orders are processed within 1-3 business days and delivered within 6-13 business days. Delivery dates are estimates only. A tracking number is provided by email once your order has been shipped.

We ship to: Austria, Australia, Aland Islands, Belgium, Brunei, Canada, Switzerland, Czech Republic, Germany, Spain, Finland, France, United Kingdom, Greece, Hong Kong, Croatia, Hungary, Ireland, Italy, Japan, Luxembourg, Netherlands, New Zealand, Poland, Portugal, Sweden, Slovenia, Slovakia, Turkey, and the United States.

An accurate shipping address is required. We are not responsible for delays or failed deliveries caused by incorrect address information provided by you.

Risk of loss or damage passes to you on delivery. For consumers in the EU and UK, risk passes when you (or a carrier you appointed yourself, other than one we offered) take physical possession of the goods.

11. Delivery Confirmation

Because circumstances at your delivery address may be beyond our control, delivery confirmation provided by the carrier is deemed sufficient proof of delivery, even without a signature. This does not affect the statutory rights of consumers in the EU and UK regarding non-delivery.

12. Shipping Costs

Applicable shipping costs and any free-shipping threshold are displayed at checkout before you complete your order.

13. Right of Withdrawal / Cancellation (Consumers in the EU and UK)

If you are a consumer in the EU or UK, you have the right to cancel your purchase within 14 days without giving any reason.

The cancellation period expires 14 days from the day you (or a third party indicated by you, other than the carrier) take physical possession of the goods.

How to cancel. To exercise this right, inform us of your decision by a clear statement, for example by email to support@sunsterbeauty.com, before the 14-day period expires. You may use the model withdrawal form in the Annex below, but it is not obligatory.

Returning the goods. After notifying us, you must send the goods back without undue delay and no later than 14 days from the day you communicated your cancellation. You bear the direct cost of returning the goods.

Refund. We will reimburse all payments received from you, including standard delivery costs, without undue delay and no later than 14 days from the day we are informed of your decision to cancel. We may withhold reimbursement until we have received the goods back or you have supplied proof of return, whichever is earliest. We will refund using the same means of payment you used, unless you expressly agree otherwise.

Deductions. You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning. For hygiene reasons, sealed skincare products that have been unsealed after delivery may not be eligible for return where permitted by law.

14. Returns

To initiate a return, contact support@sunsterbeauty.com for return instructions. Products must be unused and in their original packaging. Return shipping costs are your responsibility. Once the return has been received and inspected, we will process your refund within 14 days.

This section is in addition to, and does not limit, the statutory rights described in Sections 13 and 16.

15. 45-Day Satisfaction Guarantee

In addition to your statutory rights, if you are not satisfied with your purchase, contact us within 45 days of delivery. This is a voluntary commercial guarantee offered by us and does not affect your legal rights. Read more at sunsterbeauty.com/pages/guarantee.

16. Statutory Consumer Rights

Nothing in these Terms affects the mandatory legal rights you have as a consumer, which cannot be waived or limited.

EU consumers. You benefit from the legal guarantee of conformity. If goods do not conform to the contract, you are entitled to repair, replacement, price reduction or a refund. This guarantee applies for a minimum of two years from delivery.

UK consumers. Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. If they are not, you may be entitled to a repair, replacement or refund.

All consumers. These rights apply regardless of the commercial guarantee in Section 15 and regardless of the governing law stated in Section 24.

17. Complaints

If you have a complaint, please contact us at support@sunsterbeauty.com. We aim to respond within 24 hours.

EU consumers may also access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are, however, not obliged to and generally do not participate in alternative dispute resolution before a consumer arbitration body.

18. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, and our total liability shall not exceed the amount paid for the relevant order.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. For consumers, this Section does not affect the statutory rights described in Section 16.

19. Reviews and Submissions

If you submit reviews, testimonials, photographs, comments, ideas or other content to us or to the website ("Submissions"), you grant us a non-exclusive, royalty-free, worldwide, transferable licence to use, reproduce, adapt, publish and display that content in connection with our products and marketing, in any media. You confirm that your Submissions are accurate and do not infringe the rights of any third party. We may use Submissions together with your first name. Testimonials do not represent the generally expected user experience.

20. Intellectual Property

All content on sunsterbeauty.com, including text, images, branding, logos and trademarks, is the property of Sunster or its licensors and is protected by applicable law. Unauthorised use is prohibited. If you believe any content infringes your rights, contact us at support@sunsterbeauty.com.

21. Third-Party Links

The website may contain links to third-party websites. We are not responsible for the content, policies or practices of those websites, and any transaction you enter into with a third party is at your own risk.

22. Changes to These Terms

We may update these Terms from time to time by posting the revised version on this page. Changes apply to orders placed after the revised version is posted. The version in force at the time of your order governs that order.

23. Electronic Communications

You agree that we may communicate with you electronically, and that notices, disclosures and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

24. Governing Law and Jurisdiction

These Terms are governed by the laws of Hong Kong.

If you are a consumer resident in the EU or UK, this choice of law does not deprive you of the protection of the mandatory consumer-protection provisions of the country in which you are resident, and you retain the right to bring proceedings in the courts of your country of residence.

25. Assignment

You may not assign your rights under these Terms without our consent. We may assign or transfer our rights and obligations under these Terms, for example in connection with a merger, acquisition or sale of assets, without notice, provided this does not reduce your rights as a consumer.

26. General Provisions

No waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.

Severability. If any provision is found unlawful or unenforceable, the remaining provisions remain in full force, and the unenforceable provision applies to the fullest extent permitted by law.

Entire agreement. These Terms, together with any policies posted on the website, constitute the entire agreement between you and us regarding your purchase.
